Pay if and when
Wish you had a dollar every time you heard this excuse? This is no longer a valid excuse for delaying or
not paying claims. Nor are reasons that tie payment to another contract or party. The time has come when
the client is no longer able to impose his problems on you.
Section 12 of the Act enshrines that no longer can the stronger party hold the supplier of goods &
services to ransom after works have been completed, by using reasons of a third party not
performing.
Another contract
The only contract that is relevant is the contract between the claimant and the respondant.
